By accessing, visiting, and using the site www.ayom.id (“AYOM”) or product, data file, software, and services in any form available through the site or application associated with the domain or sub-domain of AYOM, (hereinafter wholly or partly referred to as “Site”) managed and operated by PT Mahakarya Indah Sejati, its affiliates, successors and/or successors (“We“, “Us”, “Our” or “Company”) then you, either personally or on behalf of the entity (“You”, “Your”) have understood and agreed to these terms and conditions and other provisions issued by the Company at any time but not limited to each Privacy Policy and security policy related to the use and access of the Site which can be regulated separately that we have determined apply to you and can change from time to time (“Terms and Conditions”). All of the Terms and Conditions as set out below are one unit and an inseparable part of one another.

Before You access, visit, and use the Site, you hereby declare, You: (i) knowingly entered into a legally binding agreement between You and Us; and (ii) have reached the age of majority under the laws of the Republic of Indonesia or You are accompanied by and obtain approval from your parents or legal guardians, therefore all of Your activities in using the Site are deemed to have been known and approved by your parents or guardians. If You are a legal entity, then You have met the requirements set forth by the corporate documents and applicable laws and regulations to represent Your legal entity to bind your legal entity to the provisions of these Terms and Conditions.

1. SITE AND INTELLECTUAL PROPERTY RIGHTS

The site is an asset owned by Us or its licensors, including but not limited to text, graphics, logos, images, writing, software, audio clips, icons, digital download, software, all source code (“Content”), and trademarks (“Brand”) contained therein are protected by laws and regulations related to intellectual property rights. The compilation of all Content on this site is Our exclusive property and protected by applicable copyright laws.

The Content and Brands contained on the site may only be used for Your personal use, not for publication, commercial, reproduction, or manipulation purposes in any format. We have all the exclusive rights granted to us based on laws and regulations regarding intellectual property rights.

The Company is not responsible to You or any third parties related to the use of Your account on the Site and releases any claims against the Company in any form in connection with activities that occur on Your account and when You use the account.

You agree and hereby declare that You will maintain the confidentiality of Your password and will be fully responsible for all uses of Your account and password when using and accessing the Site. If there is the use of your password and/or account without Your consent or You are aware of an attempt to breach the security of Your account, then You can immediately contact us via our Contact Us page listed on the Site.

You agree that We have the right to terminate access and close Your account on our Site if We think You have committed a violation.

4. PRODUCT INFORMATION

1. Product information displayed on the Site is only intended to be used for educational or personal information purposes. The information and statements available on the Site or those We provide through Contact Us are not intended to diagnose, treat, cure, or prevent a condition or disease.

At any time, we can correct any errors, inaccuracies, or omissions and replace or update information or cancel orders if there is inaccurate information on the Site without prior notice, including after You have completed Your order and made a payment.

5. PRODUCT AVAILABILITY

We will display all products on the Site. Please contact Us via Contact Us page to ensure stock availability of the product You want to order before You make a payment.

6. PRODUCT PAYMENT

After you receive confirmation of product availability, product prices, and other costs (including shipping costs or other fees required for payment confirmation purposes), You can make payments via the payment methods provided on the Site, including payment via debit cards, credit cards including internet banking payments, online payments, as mentioned and available on the Site.

If payment is via bank transfer, the transfer fee charged by the relevant bank will be borne entirely by You. We will confirm the payment within no more than 1 (one) x 24 (twenty-four hours) if You have made the payment on a working day.

All costs incurred in connection with the transactions mentioned in this Agreement use the Indonesian Rupiah currency.

7. PRODUCT DELIVERY

We will process Your order on working days (Monday – Friday 10.00 WIB – 17.30 WIB and Saturday 09.00 WIB – 14.30 WIB) after Your payment has been confirmed. Orders will be processed on the same day if the payment status is confirmed no later than 18.00 WIB, if it is past 18.00 WIB, then Your order will be processed on the next working day.

Delivery of goods will refer to Your choice in determining a third party as a courier to deliver goods. Delivery of goods will be carried out by the courier appointed by the buyer or a third-party agent / sub-contractor who cooperates with Us. Delivery of goods will be carried out based on the shipping address that You have registered on the Site. We are not responsible for delivery errors that result from incorrect input of address information by You.

8. REFUSAL OF ORDERS

In the event of a discrepancy in any form, We have the right to refuse and or cancel orders that have already occurred, and incoming payments will be refunded in accordance with these Terms and Conditions.

9. RETURN OF GOODS

You can return goods to Us if the product received does not match the specifications, type, and/or number of products that You have ordered through the Site, a maximum of 2 (two) working days after You have received the related product. You must attach photo and video evidence of the non-conforming products, including an unboxing video of the product pack. Returned products must be in perfect condition (new & sealed).

If the period for returning goods has passed, then You are declared to have agreed that the product You received complies with the specifications, type and/or quantity that You ordered earlier.

10. FORCE MAJEURE

We are released from liability for violations, obstructions, and delays in carrying out obligations caused by circumstances beyond Our control, including but not limited to:

1. Natural disasters, fires, earthquakes, floods, landslides;
2. Pandemic or epidemic outbreak of disease;
3. War, rebellion, riots, plunder, sabotage, bombing, blockade, and disorder as a result of terrorist acts;
4. Limited or unusable public telecommunications networks;
5. Actions, decisions, laws and regulations or restrictions from governments, delivery services, postal or transport-related strikes, failures or accidents.
   
   

If the things set out above happen, You hereby understand and agree that any events that arise outside of Our control (including officers, directors, commissioners, employees, agents, subcontractors, or third parties appointed) will be released from liability.

If the force majeure lasts more than 7 (seven) calendar days, You or We can immediately cancel the order with written notification.

11. OUR RIGHTS ON ORDERS

We reserve the right to limit or reject Your orders and verify the legitimacy of each order. If there is evidence of fraud, interference, or violation of these Terms and Conditions, We may cancel the order. There is also the possibility of limiting the number of purchases per person, household, or order. If orders are made under the same account, credit card or shipping address, these restrictions may apply. We also reserve the right not to deliver goods to certain addresses, and if this happens, the amount charged will be reduced.

12. LIMITATION OF LIABILITY

We (including officers, directors, commissioners, employees and agents) are not responsible for any direct, indirect, incidental, consequential, punitive or special damages caused by:

1. anything arising from the use, inability to use, errors, negligence of the Contents and functions of this Site;
2. personal injury or damage of any type arising from Your access to and use of the Site;
3. any unauthorized access or unauthorized use of Our security server and/or any and all personal information and/or financial information stored on Our server;
4. any interruption or interruption of transmission to or from Our Site; and/or
5. any viruses, bugs, trojan horses or the like that may be transmitted to or through Our services by any third party.

13. COMPENSATION

You agree to release and release Us including officers, directors, commissioners, employees, agents, or other third parties from claims, damages, obligations, losses, responsibilities, costs, interest, debts including other costs that may arise such as legal consultant fees that arise from (i) violations regulated in these Terms and Conditions; (ii) your misuse of the Site; and (iii) violation of applicable laws and regulations that may affect third parties.

You understand and agree that You are personally responsible for Your behavior using the Site. You agree to indemnify, claim, costs, damages, or legal consulting fees if there is damage, violation, misuse, or inability to use this Site properly.

The obligations referred to above will continue to apply even though these Terms and Conditions are deemed to have ended and You are no longer using the Site.

By submitting Your e-mail address in connection with Your account, You agree that We can use Your e-mail address to communicate with You regarding Your account on the Site or for other administrative purposes or any other purposes permitted or required by law. We can change, add, or update these Terms and Conditions at any time without notification to You. You acknowledge and agree to always be subject to and bound by such changes, additions and updates. 16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions are regulated and must be interpreted based on the applicable laws in the Republic of Indonesia. You agree that any disputes or disputes arising in connection with the site and/or these Terms and Conditions will be resolved through deliberation to reach a consensus. If the dispute or dispute cannot be resolved by deliberation for consensus within 30 (thirty) days after the deliberation is held, the parties agree to resolve it through the Indonesian National Arbitration Board in Jakarta, Indonesia.

17. INTEGRATION

If any part of these Terms and Conditions becomes invalid as a result of changes in laws and regulations or court decisions, the invalidity of these provisions will not affect the validity of the other provisions of these Terms and Conditions and other provisions will remain binding on the parties.

18. LANGUAGE

These Terms and Conditions are made in English and Indonesian version. If there are differences in interpretation between the Indonesian and English versions of these Terms and Conditions, the Indonesian version will prevail and the English version is deemed to have been automatically changed to conform with the relevant Indonesian version of the text.
